A IMPORTÂNCIA DA ESPIRITUALIDADE NA RESSOCIALIZAÇÃO DOS APENADOS EM REGIME FECHADO DA PENITENCIÁRIA ODENIR GUIMARÃES

Resumo

O presente artigo versa sobre a relevância da espiritualidade/religiosidade no processo de ressocialização dos apenados. Levando-se em consideração que no Brasil mais de 700 mil pessoas estão enclausuradas sendo, desse modo, considerada a terceira maior população carcerária do mundo, é notável a importância deste tema. A formulação dos pressupostos teóricos é basilar na construção de um alicerce sólido capaz de sustentar uma avaliação crítica das políticas públicas atuais. Nesse sentido, uma leitura da Constituição Federal, da Lei de Execução Penal – LEP (1984) e da Declaração Universal dos Direitos Humanos (DUDH), será fundamental para identificar o papel do Estado e da sociedade no processo de ressocialização dos apenados. Sendo assim, o objetivo deste estudo é destacar a importância da espiritualidade/religiosidade como instrumento neste processo. O fato é que, diante da realidade caótica das prisões brasileiras, nos admiramos ao identificar como alguns apenados experimentam algum tipo de recuperação, ainda dentro do cárcere ou mesmo fora dele, quando não voltam a delinquir. A questão-problema que se apresenta é: teria a espiritualidade/religião algum papel nesse processo de ressocialização do recuperando? Já que o desenvolver da espiritualidade se faz presente neste ambiente, bem como é uma das garantias previstas em lei aos privados de liberdade, cabe o acesso à assistência religiosa/espiritual. A metodologia utilizada se baseia no estudo bibliográfico de literaturas estruturadas, obtidas de livros e artigos científicos provenientes de biblioteca convencionais e virtuais, bem como pesquisa de campo realizada com amostra da população carcerária, onde o estudo descritivo – exploratório visa à aproximação e familiaridade com o fenômeno. Destarte, compreender como acontece este desenvolver da espiritualidade no ambiente prisional e de que maneira interfere na recuperação do encarcerado é um passo importante para valorizar a assistência religiosa/espiritual e para apontar uma direção para a reintegração social do egresso.

ABSTRACT

This article deals with the relevance of spirituality/religiosity in the process of resocialization of the grieving. Taking into account that in Brazil more than 700 thousand people are cloistered, being thus considered the third largest prison population in the world, the importance of this theme is remarkable. The formulation of theoretical assumptions will be based on the construction of a solid foundation capable of sustaining a critical evaluation of current public policies. In this sense, a reading of the Federal Constitution, the Criminal Enforcement Law - LEP (1984) and the Universal Declaration of Human Rights will be fundamental to identify the role of the State and society in the process of resocialization of the victims. Therefore, the purpose of this study is to highlight the importance of spirituality/religiousness as an instrument in this process. When faced with the chaotic reality of Brazilian prisons, we marvel at how some of the victims experience some kind of recovery, still inside the prison or even outside it, when they do not return to crime. The problem question that arises is: would spirituality/religion have any role in this process of resocialization of the recovering? Since the development of spirituality is present in this environment, and it is one of the guarantees provided by law to the deprived of freedom access to religious / spiritual assistance. The methodology used is based on a bibliographical study of structured literatures, obtained from books and scientific articles from conventional and virtual libraries, as well as a field research carried out with a sample of the prison population, where the descriptive - exploratory study aims at the approximation and familiarity with the phenomenon. Understanding how this development of spirituality in the prison environment and how it interferes with the recovery of the incarcerated person is an important step in enhancing religious / spiritual care and in pointing a direction towards the social reintegration of the prisoner.
